Malaster makes reasonable efforts to ensure that product descriptions, specifications, images, pricing, and availability are accurate. However, errors, omissions, discontinued items, or specification changes may occur.

Product images are provided for general reference and may not represent every size, material, color, configuration, or variation available. Customers are responsible for confirming that products meet their application requirements before purchase.

4. Quotes, Pricing, and Availability

All prices, quotations, and availability are subject to change without notice unless otherwise stated in writing. Quoted pricing is valid only for the period stated on the quotation.

Malaster reserves the right to correct pricing errors, reject orders, cancel orders, or revise quotations due to supplier changes, material availability, freight changes, typographical errors, or other business conditions.

5. Orders and Acceptance

Submission of an order does not constitute acceptance by Malaster. Orders are subject to review and approval. Malaster reserves the right to accept, reject, or cancel any order for any reason, including product availability, pricing errors, payment issues, suspected fraud, or inability to fulfill customer requirements.

Order confirmations acknowledge receipt of an order but do not necessarily represent final acceptance unless expressly stated.

6. Payment Terms

Payment terms are determined by Malaster and may vary by customer, order type, or credit approval status. Payment may be required before shipment unless written credit terms have been approved.

Customers are responsible for all applicable taxes, duties, tariffs, freight charges, handling charges, and other fees associated with their order unless otherwise stated in writing.

7. Shipping and Delivery

Shipping dates and delivery estimates are provided for convenience only and are not guaranteed. Malaster is not responsible for delays caused by carriers, suppliers, customs, weather, labor disruptions, material shortages, or other circumstances beyond our control.

For international orders, the customer is responsible for all customs duties, taxes, import fees, brokerage fees, and compliance with applicable import laws.

8. Returns and Refunds

Returns are subject to Malaster’s Refund and Returns Policy. Many products supplied by Malaster are custom, engineered-to-order, special-order, or sourced specifically for customer requirements and may not be eligible for return.

9. Custom and Special-Order Products

Custom products, modified products, special-order items, and products manufactured or sourced to customer specifications may not be canceled, returned, or refunded once production, procurement, or processing has begun.

Customer approval of drawings, specifications, samples, or quotations may be required before production. Customers are responsible for verifying that all submitted requirements are accurate.

10. No Warranty

Products are provided in accordance with applicable manufacturer specifications where available. Except as expressly stated in writing, Malaster makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Customers are responsible for determining whether a product is suitable for their intended use, application, process, or environment.

11. Limitation of Liability

To the fullest extent permitted by law, Malaster shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost profits, production delays, business interruption, loss of data, or loss of use.

Malaster’s total liability for any claim shall not exceed the amount paid by the customer for the specific product or order giving rise to the claim.

12. Intellectual Property

All website content, product images, graphics, text, logos, trademarks, technical materials, and other intellectual property are owned by The Malaster Company, Inc. or its licensors. Unauthorized copying, reproduction, modification, distribution, or commercial use is prohibited.

13. Compliance

Customers are responsible for ensuring that products purchased from Malaster are used in compliance with applicable laws, regulations, industry standards, and customer-specific requirements.

14. Changes to Terms and Conditions

Malaster reserves the right to update or modify these Terms and Conditions at any time. Updates will be posted on this page with a revised effective date. Continued use of the website or placement of orders after changes are posted constitutes acceptance of the updated terms.

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, United States. Any disputes shall be subject to the jurisdiction of the courts located in Santa Clara County, California.
